Tote Sharks LLC Terms of Service

By purchasing, using and/or accessing Tote Sharks LLC's services you are deemed to have read and agreed to the following Terms of Service:
The following terminology applies to these Terms of Service: “Renter”, “You” and “Your” refer to you, the person purchasing, using and/or accessing our services and thereby accepting our Terms of Service. “Tote Sharks”, “Ourselves”, “Our”, “We” and “Us”, refer to Tote Sharks LLC and/or its employees, representatives, agents, or others for whom Tote Sharks LLC is legally responsible. “Party” or “Parties” refers to both the Renter and Tote Sharks, or either the Renter or Tote Sharks. “Services” refers to any and all services, programs, products and/or other offerings on our website, including, but not limited to the renting, delivery and pick up of the equipment. “Equipment” means any and all equipment rented to the Renter, including but not limited to the bins. “Rental Period” means the duration of the rental of equipment from Tote Sharks to the Renter as identified on the Renter’s invoice. “Website” refers to https://totesharks.com/. These Terms of Service apply to all users of our services and/or equipment. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she/it or they, are taken as interchangeable and therefore as referring to same.
Overview of Services
Upon purchase of our services, Tote Sharks shall rent the equipment to the Renter for the rental period. At the commencement of the rental period, Tote Sharks shall deliver the equipment to the Renter’s designated delivery address and at the end of the rental period, will pick up the equipment from the Renter’s designated pickup address. Tote Sharks does not assist with packing or moving, which shall be the sole responsibility of the Renter. All equipment shall remain the sole and exclusive property of Tote Sharks LLC.
Rental Period
Tote Sharks’ standard minimum rental period is fourteen (14) days. If the Renter returns the equipment before the end of the fourteen-day rental period, no refund, credit, or prorated adjustment will be provided. The full fourteen-day rental charge will apply regardless of the actual number of days the equipment is used. Longer rental periods may be available, subject to equipment availability and any applicable extension fees.
Delivery Area
Tote Sharks provides delivery and pickup services only within its designated service area. Service availability is determined based on the delivery and pickup addresses provided by the Renter and is subject to scheduling, equipment availability, and applicable delivery fees. Tote Sharks may, at its sole discretion, provide service outside its standard service area for an additional fee. Current service areas and applicable delivery fees are available on our Website.
Reserving Equipment
The Renter must select the desired rental package through the Tote Sharks Website. All rentals are subject to the fourteen (14) day minimum rental period and the terms applicable to the selected package. Tote Sharks offers multiple rental package sizes, including packages beginning at five (5) totes, as well as custom rental packages. The quantity of totes, equipment, and optional add-ons included in each rental will be based on the package selected or the custom rental arrangement approved by Tote Sharks.
Submission of an order does not guarantee equipment availability or constitute confirmation of the rental. Tote Sharks will review the order, requested rental dates, delivery location, and equipment availability before confirming the reservation. A reservation is considered confirmed only after Tote Sharks has issued confirmation by email or other electronic communication and any required payment or deposit has been successfully processed.
All rentals are subject to equipment availability, delivery-area requirements, applicable fees, and these Terms of Service.
Payment
Payment for the Renter’s selected rental package, delivery fees, equipment, add-ons, and any other applicable charges is due at the time of booking unless otherwise stated by Tote Sharks.
All online payments are processed through Stripe, a third-party payment processor. Tote Sharks does not directly store the Renter’s complete credit or debit card information.
Submission of payment does not guarantee equipment availability. If Tote Sharks is unable to fulfill the requested rental, the Renter will be notified and any payment collected for the unavailable rental will be refunded.
By completing a rental transaction, the Renter agrees to pay all charges associated with the rental, including the rental package price, applicable delivery and pickup fees, optional add-ons, approved rental extensions, applicable taxes, and any other charges authorized under these Terms of Service.
If the Renter authorizes a payment method to be kept on file, the Renter authorizes Tote Sharks to use that payment method for amounts that later become due under this Agreement, including approved extensions, late fees, damage charges, cleaning charges, replacement costs for lost or unreturned equipment, and other amounts properly due under these Terms of Service.
All prices and fees are subject to applicable taxes. Refunds, cancellations, and credits will be handled in accordance with Tote Sharks’ cancellation and refund policies.
Changes to Order
The Renter should contact Tote Sharks as soon as possible to request any change to a reservation, including changes to rental dates, rental duration, delivery or pickup information, package size, tote quantity, equipment, or optional add-ons. All requested changes are subject to availability and approval by Tote Sharks.
Changes to delivery or pickup dates that do not increase the rental period may be accommodated without an additional rental charge; however, additional delivery, pickup, rescheduling, or service-area fees may apply depending on the requested change.
If a requested change extends the rental beyond the original rental period, the Renter will be responsible for all applicable extension charges. Tote Sharks may charge the payment method on file for an approved extension or other authorized change in accordance with these Terms of Service.
The Renter may request additional totes, equipment, or add-ons at any time, subject to availability. If the original order has not yet been delivered, the Renter will be responsible for the additional rental charges and any applicable fees. If additional equipment requires a separate delivery after the original order has been delivered, an additional delivery fee may apply.
If Tote Sharks is unable to accommodate a requested change, the original reservation will remain in effect unless the Renter cancels the reservation in accordance with the applicable cancellation and refund policy.
Cancellation Policy
Cancellations must be submitted to Tote Sharks by phone, text, email, or another approved method of communication.
If the Renter cancels a confirmed reservation more than forty-eight (48) hours before the scheduled delivery time, Tote Sharks will refund ninety-five percent (95%) of the amount paid. Five percent (5%) will be retained as a cancellation and administrative fee to help offset payment-processing and administrative costs associated with the reservation.
If the Renter cancels a confirmed reservation between twenty-four (24) and forty-eight (48) hours before the scheduled delivery time, Tote Sharks will refund eighty-five percent (85%) of the amount paid. Fifteen percent (15%) will be retained as a late cancellation fee to help offset payment-processing costs, scheduling, order preparation, reserved equipment, loading, administrative time, and other costs incurred in preparing to fulfill the reservation.
If the Renter cancels a confirmed reservation less than twenty-four (24) hours before the scheduled delivery time, no refund or credit will be issued.
Once the equipment has been delivered, the rental period is considered to have begun and no refund or credit will be provided for cancellation, early return, unused rental days, or unused equipment.
If Tote Sharks cancels a confirmed reservation because Tote Sharks is unable to provide the reserved equipment or service, the Renter will receive a full refund of all amounts paid for the affected reservation.
Any refund due under this policy will be issued to the original payment method used for the transaction.
Delivery

Tote Sharks provides delivery and pickup within its designated service area. Delivery and pickup fees, if applicable, will be disclosed at the time of booking and may vary based on the Renter’s location, selected package, and other applicable service requirements.

The Renter is responsible for providing accurate delivery and pickup addresses and selecting available delivery and pickup dates or time windows as required by Tote Sharks.

Delivery dates and time windows are subject to availability. Tote Sharks will make reasonable efforts to accommodate the Renter’s requested schedule but does not guarantee a specific delivery or pickup time unless expressly confirmed.

The Renter must ensure that Tote Sharks has safe and reasonable access to the designated delivery or pickup location. The Renter or an authorized representative must be available when required. If delivery or pickup cannot be completed because of inaccurate information, lack of access, unsafe conditions, or the Renter’s failure to be available when required, additional delivery, pickup, or rescheduling fees may apply.

Tote Sharks may reschedule a delivery or pickup because of severe weather, vehicle problems, emergencies, unsafe conditions, traffic disruptions, or other circumstances beyond its reasonable control. Tote Sharks will make reasonable efforts to notify the Renter and arrange an alternative delivery or pickup time.

No damage deposit is required at the time of booking or delivery. However, as provided elsewhere in these Terms of Service, the Renter remains financially responsible for lost, stolen, damaged, excessively dirty, or unreturned totes, equipment, and accessories, as well as other properly authorized charges. Where the Renter has authorized a payment method to be saved for future use, Tote Sharks may charge that payment method for amounts properly due under these Terms of Service.

Tote Sharks will make reasonable efforts to notify the Renter of any post-rental charge and provide a description of the charge, including applicable replacement, damage, cleaning, late-return, or other authorized fees.

Tote Sharks will not be responsible for delays caused by circumstances beyond its reasonable control. Nothing in this section limits any rights or remedies that cannot legally be waived.
Pick Up

Tote Sharks provides pickup within its designated service area. Pickup fees, if applicable, will be disclosed at the time of booking and may vary based on the Renter’s location, selected package, or other applicable service requirements.

The Renter is responsible for selecting or confirming an available pickup date or time window as required by Tote Sharks. Pickup dates and time windows are subject to availability.

On the scheduled pickup date, all rented totes, equipment, and accessories must be emptied, reasonably clean, gathered together, and readily accessible for pickup. The Renter must ensure that Tote Sharks has safe and reasonable access to the equipment.

If Tote Sharks is unable to complete the scheduled pickup because the equipment is not ready, cannot be accessed, the address or information provided is incorrect, or the Renter or authorized representative is unavailable when required, additional pickup, rescheduling, or rental-extension fees may apply.

If the Renter needs to extend the rental period, the Renter must contact Tote Sharks before the scheduled pickup. Extensions are subject to availability and applicable extension charges. The Renter’s saved payment method may be charged for an approved extension in accordance with these Terms of Service.

Tote Sharks may reschedule a pickup because of severe weather, vehicle problems, emergencies, unsafe conditions, traffic disruptions, or other circumstances beyond its reasonable control. Tote Sharks will make reasonable efforts to notify the Renter and arrange an alternative pickup time. If Tote Sharks causes the pickup to occur after the scheduled end of the rental period, the Renter will not be charged an extension fee solely because of that delay.

The Renter remains responsible for the rented equipment until it has been physically retrieved by Tote Sharks. The Renter must take reasonable steps to protect the equipment from loss, theft, misuse, or damage while awaiting pickup.
Self Pick up

Self pickup is available only by appointment and is subject to equipment availability. The Renter must select or confirm an available pickup date and time window as required by Tote Sharks.

The Renter must arrive during the scheduled self-pickup window. If the Renter is unable to make the scheduled appointment, the Renter must notify Tote Sharks as soon as possible to request a new appointment. Rescheduling is subject to availability, and additional fees may apply where appropriate.

Tote Sharks may reschedule a self-pickup appointment because of severe weather, emergencies, equipment availability issues, unsafe conditions, or other circumstances beyond its reasonable control. Tote Sharks will make reasonable efforts to notify the Renter and arrange an alternative pickup time.

No damage deposit is required for self pickup. However, the Renter remains financially responsible for all rented totes, equipment, and accessories in accordance with these Terms of Service.

Responsibility for the rented equipment transfers to the Renter when the equipment is released to the Renter or the Renter’s authorized representative. From that time until the equipment is returned to and accepted by Tote Sharks, the Renter is responsible for loss, theft, misuse, excessive cleaning, damage, or failure to return the equipment.

Where the Renter has authorized a payment method to be saved for future use, Tote Sharks may charge that payment method for amounts properly due under these Terms of Service, including approved extensions, late fees, cleaning charges, damage charges, and replacement costs for lost, stolen, damaged, or unreturned equipment.

If the Renter fails to appear for a scheduled self-pickup appointment and does not timely notify Tote Sharks, the reservation may be subject to the applicable cancellation, rescheduling, and refund policies contained in these Terms of Service.

Self Drop off

Self drop-off is available only by appointment and is subject to available return time windows. The Renter must select or confirm an available drop-off date and time as required by Tote Sharks.

On the scheduled drop-off date, all rented totes, equipment, and accessories must be emptied, reasonably clean, and returned together unless Tote Sharks has approved another arrangement in advance.

The Renter remains responsible for all rented equipment until it has been physically returned to and accepted by Tote Sharks. Responsibility does not end merely because the equipment has been left at or near the return location.

If the Renter is unable to make the scheduled drop-off appointment, the Renter must notify Tote Sharks as soon as possible to request a new appointment. Rescheduling is subject to availability. Extension, late-return, or other applicable fees may apply if the equipment is retained beyond the agreed rental period.

Tote Sharks may reschedule a drop-off appointment because of severe weather, emergencies, unsafe conditions, operational issues, or other circumstances beyond its reasonable control. Tote Sharks will make reasonable efforts to notify the Renter and arrange an alternative return time. The Renter will not be charged an extension fee solely because Tote Sharks required the appointment to be rescheduled.

Upon return, Tote Sharks may inspect the equipment for missing items, excessive cleaning needs, misuse, or damage beyond ordinary wear and tear. The Renter remains financially responsible for any amounts properly due under these Terms of Service, including applicable extension fees, late fees, cleaning charges, damage charges, and replacement costs for lost, stolen, damaged, or unreturned equipment.

Where the Renter has authorized a payment method to be saved for future use, Tote Sharks may charge that payment method for amounts properly due under these Terms of Service. Tote Sharks will make reasonable efforts to notify the Renter of any post-rental charge and provide a description of the charge.

Failure to Return Equipment / Failed Pickup
If the Renter fails to return the rented equipment by the agreed return date, refuses or prevents Tote Sharks from retrieving the equipment, fails to provide reasonable access for a scheduled pickup, or otherwise retains the equipment beyond the agreed rental period without an approved extension, the Renter will be considered in possession of the equipment beyond the authorized rental period.
The Renter will remain responsible for all rented totes, equipment, and accessories until they are physically returned to and accepted by Tote Sharks.
If a scheduled pickup cannot be completed because the equipment is not ready, the Renter or authorized representative is unavailable when required, access is denied or unavailable, or the Renter otherwise prevents completion of the pickup, Tote Sharks may charge reasonable rescheduling, additional pickup, and rental-extension fees as provided in these Terms of Service or disclosed to the Renter.
Tote Sharks will make reasonable efforts to contact the Renter and arrange for the return or retrieval of overdue equipment. If the equipment remains unreturned after notice and a reasonable opportunity to return it, Tote Sharks may charge the Renter for continued rental or late-return fees and, where appropriate, the replacement cost of lost or unreturned equipment.
Where the Renter has authorized a payment method to be saved for future use, Tote Sharks may charge that payment method for amounts properly due under these Terms of Service, including authorized extension charges, reasonable pickup or rescheduling fees, late-return fees, and replacement costs for equipment that is lost, damaged, or not returned.
Payment of a replacement charge does not relieve the Renter of any other obligations arising from misuse, loss, theft, or damage occurring while the equipment was in the Renter’s possession.
Condition of Equipment
Tote Sharks will provide rented totes, equipment, and accessories in reasonably clean and serviceable condition, subject to ordinary wear and tear from prior use.
Upon delivery or self pickup, the Renter is responsible for inspecting the equipment and promptly reporting any visible damage, defects, missing items, or other concerns to Tote Sharks. The Renter should notify Tote Sharks within twenty-four (24) hours after receiving the equipment and, when possible, provide photographs or other documentation of the condition.
If a defect or pre-existing damage is reported within the twenty-four (24) hour inspection period, Tote Sharks may, at its discretion and subject to availability, repair or replace the affected equipment at no additional rental charge to the Renter.
If the Renter does not report visible damage, defects, or missing equipment within twenty-four (24) hours after receiving the equipment, the equipment will be presumed to have been received in reasonably acceptable condition, except for defects that could not reasonably have been discovered during an ordinary inspection.
The Renter will not be responsible for ordinary wear and tear resulting from normal and proper use of the equipment. The Renter may be responsible for damage, loss, excessive cleaning, misuse, or other deterioration beyond ordinary wear and tear that occurs while the equipment is in the Renter’s possession.
Damage, Loss, Cleaning, and Replacement Charges
Tote Sharks does not require a damage deposit. However, the Renter is financially responsible for rented totes, equipment, and accessories while they are in the Renter’s possession.
The Renter may be charged for equipment that is lost, stolen, unreturned, misused, or damaged beyond ordinary wear and tear. Charges may include reasonable repair or replacement costs, as well as cleaning charges assessed in accordance with the Cleaning Fees section of these Terms of Service.
Ordinary wear and tear resulting from normal and proper use will not result in a damage charge.
Where the Renter has authorized a payment method to be saved for future use, Tote Sharks may charge that payment method for amounts properly due under these Terms of Service, including reasonable repair costs, replacement costs, late-return charges, cleaning fees assessed under the Cleaning Fees section, or other authorized amounts resulting from loss, damage, misuse, or failure to return rented equipment.
Before processing a post-rental damage, cleaning, or replacement charge, Tote Sharks will make reasonable efforts to notify the Renter and provide a description of the charge and, when appropriate, supporting photographs or other documentation.
The Renter remains responsible for amounts due even if the cost of repairing or replacing the affected equipment exceeds the value of any individual rental package.
Cleaning Fees
Tote Sharks will provide rented totes, equipment, and accessories in reasonably clean and sanitized condition at the beginning of the rental period.
The Renter is not required to perform routine cleaning before returning the equipment. However, the equipment must be returned free of excessive dirt, debris, pet hair, food residue, liquids, odors, hazardous materials, or other conditions requiring cleaning beyond Tote Sharks’ normal between-rental cleaning process.
If equipment requires excessive or specialized cleaning because of the Renter’s use, Tote Sharks may charge a reasonable cleaning fee based on the amount of equipment affected, the condition of the equipment, and the labor, materials, or other costs reasonably required to restore the equipment to rentable condition.
Where the Renter has authorized a payment method to be saved for future use, Tote Sharks may charge that payment method for cleaning fees properly due under these Terms of Service. Tote Sharks will make reasonable efforts to notify the Renter of the charge and provide a description of the condition requiring additional cleaning.
Ordinary cleaning associated with normal and proper use of the equipment will not result in an additional cleaning charge.
Replacement Fees
Proper care of all rented equipment during the rental period is the responsibility of the Renter. The Renter may be charged replacement costs for equipment that is lost, stolen, unreturned, misused, or damaged beyond ordinary wear and tear while in the Renter’s possession.
The following replacement charges will apply unless Tote Sharks determines that a lower reasonable repair cost is appropriate:

Commercial-grade tote: $30.00 each

Tote dolly: $85.00 each

Convertible hand truck / dolly: $225.00 each

Appliance dolly with strap: $300.00 each

Moving blanket: $15.00 each
These replacement charges are intended to reasonably cover the cost of replacing the affected equipment, including applicable sales tax, shipping, handling, reasonable procurement expenses, and other replacement-related costs.
Where the Renter has authorized a payment method to be saved for future use, Tote Sharks may charge that payment method for replacement costs properly due under these Terms of Service. Tote Sharks will make reasonable efforts to notify the Renter before processing a replacement charge and, when appropriate, provide photographs or other documentation supporting the charge.
The Renter must not apply tape, adhesive labels, paint, permanent markings, or make alterations to any rented equipment without the prior written approval of Tote Sharks. Damage caused by unauthorized alterations, adhesives, markings, misuse, or improper handling may result in reasonable repair or replacement charges.
Ordinary wear and tear resulting from normal and proper use will not result in a replacement charge.
Assumption of Risk and Safe Use
The Renter acknowledges that the use, loading, unloading, lifting, transporting, and moving of totes and rental equipment may involve risks of personal injury, property damage, falls, strains, pinching, crushing, tipping, or other accidents if the equipment is used improperly or beyond the user’s physical ability.
The Renter is responsible for using all rented equipment in a safe and reasonable manner, following any instructions or warnings provided by Tote Sharks or the equipment manufacturer, and ensuring that any person using the equipment is physically capable of doing so safely.
The Renter must not overload, misuse, modify, or use any rented equipment for a purpose for which it was not reasonably intended.
To the fullest extent permitted by applicable law, Tote Sharks will not be responsible for injuries, losses, or property damage resulting from the Renter’s misuse of the equipment, failure to follow instructions or warnings, overloading, unsafe handling, unauthorized modification, or use of the equipment by an individual who is not capable of using it safely.
Nothing in these Terms of Service is intended to waive or limit any liability or legal right that cannot lawfully be waived or limited under applicable law.
Limitation of Liability and Indemnification

To the fullest extent permitted by applicable law, Tote Sharks will not be liable for indirect, incidental, special, or consequential damages arising from the Renter’s use or misuse of rented equipment, including loss resulting from delays, scheduling changes, improper loading, improper handling, overloading, unauthorized use, or failure to follow instructions or warnings.
Tote Sharks will not be responsible for personal injury, property damage, loss, or other claims caused by the Renter’s misuse of the equipment, negligence, failure to follow instructions or warnings, unauthorized modification, overloading, or use of the equipment for a purpose for which it was not reasonably intended.
The Renter is responsible for damage, injury, loss, claims, or expenses resulting from the Renter’s own acts or omissions or those of any person using the rented equipment with the Renter’s permission.
To the fullest extent permitted by law, the Renter agrees to indemnify and hold Tote Sharks LLC harmless from third-party claims, damages, losses, or reasonable expenses arising from the Renter’s misuse of the equipment, violation of these Terms of Service, or negligent or wrongful acts while the equipment is in the Renter’s possession.
Nothing in these Terms of Service is intended to exclude or limit liability for Tote Sharks’ own gross negligence, intentional misconduct, or any liability or legal remedy that cannot lawfully be excluded or limited.
Rules & Warnings
The Renter agrees to use all totes, tote dollies, convertible hand trucks, appliance dollies, moving blankets, and other rented equipment safely, responsibly, and only for their intended purposes.
The following rules and safety requirements apply:

Totes must not be loaded with more than sixty (60) pounds of contents per tote.

Loaded totes must be stacked only to a safe and stable height and must never be stacked in a manner that creates a tipping, falling, crushing, or other safety hazard.

Totes must not be stood on, climbed on, used as steps, seats, platforms, or used for any purpose other than the safe storage and transportation of appropriate household or business items.

Children must not be permitted to operate tote dollies, convertible hand trucks, appliance dollies, or other moving equipment.
-
People or animals must not be placed inside, transported in, or permitted to ride upon any tote, dolly, hand truck, appliance dolly, or other rented equipment.

Tote dollies, convertible hand trucks, and appliance dollies must not be overloaded and must be used only in accordance with their intended purpose, manufacturer-rated capacity, and any instructions or warnings provided with the equipment.

The Renter must use particular caution when moving heavy items or using equipment on stairs, ramps, slopes, uneven surfaces, near vehicles, through doorways, or in other areas where tipping, falling, crushing, or loss of control could occur.

The Renter is responsible for determining whether an item can be safely lifted, moved, loaded, stacked, or transported and for obtaining adequate assistance when reasonably necessary.

Rented totes and equipment must not be used to store or transport hazardous, illegal, flammable, explosive, corrosive, toxic, or otherwise dangerous materials.

The Renter must not alter, modify, dismantle, misuse, remove safety features from, or make unauthorized repairs to any rented equipment.

The Renter must follow all safety instructions, warning labels, weight limits, and manufacturer instructions supplied with or displayed on the rented equipment.
Failure to follow these rules may result in reasonable repair, cleaning, replacement, or other charges permitted under these Terms of Service and may result in termination of the rental where continued use of the equipment presents a safety risk.
Nothing in this section is intended to waive or limit any right, obligation, or liability that cannot lawfully be waived or limited under applicable law.
Termination of Service
Tote Sharks may terminate or suspend a rental or refuse further service if the Renter materially violates these Terms of Service, fails to make required payments, misuses the equipment, creates an unsafe condition, refuses to return rented equipment, or otherwise materially defaults under the rental agreement.
Upon termination or default, the Renter must immediately discontinue use of the rented equipment and make all totes, dollies, hand trucks, appliance dollies, moving blankets, and other rented property available for return or retrieval at a location reasonably accessible to Tote Sharks.
Tote Sharks may recover its rented equipment to the extent permitted by applicable law. Tote Sharks will not enter a residence, locked structure, secured area, or other location requiring forced entry or unauthorized access in order to retrieve equipment.
The Renter remains responsible for all amounts properly due under these Terms of Service through the date the equipment is returned to and accepted by Tote Sharks, including applicable rental charges, approved extensions, reasonable pickup or recovery expenses, repair or replacement costs, and other authorized charges.
Where the Renter has authorized a payment method to be saved for future use, Tote Sharks may charge that payment method for amounts properly due under these Terms of Service.
Termination of the rental does not eliminate obligations or liabilities that arose before termination, including the Renter’s responsibility to return Tote Sharks’ property and pay amounts properly due.
Force Majeure
Tote Sharks will not be considered in breach of these Terms of Service for any delay, interruption, rescheduling, or failure to perform caused by circumstances beyond its reasonable control.
Such circumstances may include, but are not limited to, hurricanes, tropical storms, flooding, severe weather, fire, natural disasters, mandatory evacuations, road closures, government orders, public emergencies, epidemics or pandemics, war, terrorism, civil unrest, utility or power outages, transportation disruptions, vehicle breakdowns caused by circumstances beyond Tote Sharks’ reasonable control, or other similar events that prevent or materially interfere with the safe and reasonable performance of services.
If a force majeure event affects a scheduled delivery, pickup, self pickup, or self drop-off, Tote Sharks will make reasonable efforts to notify the Renter and reschedule the affected service as soon as reasonably practical.
The Renter will not be charged an extension, late-return, or rescheduling fee solely because Tote Sharks is unable to complete a scheduled service due to a qualifying force majeure event.
If a force majeure event makes performance of the rental impracticable for an extended period, Tote Sharks and the Renter may agree to reschedule or cancel the affected portion of the rental. Any refund or credit, if applicable, will be determined based on services already provided, equipment already delivered, and the circumstances of the event.
Nothing in this section excuses payment obligations or other responsibilities that arose before the force majeure event unless otherwise required by applicable law.
General
By purchasing, renting, or using Tote Sharks’ services or equipment, the Renter represents that the Renter is at least eighteen (18) years of age and has the legal capacity to enter into this Agreement.
These Terms of Service and any rental transaction between the Renter and Tote Sharks LLC shall be governed by and construed in accordance with the laws of the State of Mississippi, without regard to conflict-of-law principles.
Any legal action arising from or relating to these Terms of Service or the rental of Tote Sharks equipment shall be brought in a court of competent jurisdiction as permitted by applicable law.
If any provision of these Terms of Service is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect.
Tote Sharks’ failure to enforce any provision of these Terms of Service on one occasion shall not constitute a waiver of that provision or of Tote Sharks’ right to enforce that or any other provision in the future.
These Terms of Service, together with the Renter’s confirmed order, applicable package terms, pricing, and any written policies expressly incorporated into the rental, constitute the agreement between Tote Sharks and the Renter regarding the rental transaction.
Any modification, exception, or special arrangement relating to an individual rental must be approved by Tote Sharks and documented in writing or other electronic communication.
Notification of Changes
Tote Sharks may update or revise these Terms of Service from time to time to reflect changes in its services, equipment, pricing, policies, business practices, or applicable law.
Any revised Terms of Service will become effective when posted on the Tote Sharks Website or on another effective date stated in the updated terms. The date of the most recent revision should be identified on the Terms of Service page.
Changes to these Terms of Service will not retroactively alter the material terms of a rental that was already confirmed before the effective date of the change, unless the Renter and Tote Sharks agree otherwise or the change is required by applicable law.
Rentals booked after revised Terms of Service become effective will be governed by the version in effect at the time the reservation is confirmed.
The Renter is responsible for reviewing the Terms of Service presented or made available during the booking process. Where Tote Sharks requires acceptance of the Terms of Service at checkout, completion of that acceptance process will constitute the Renter’s agreement to the terms applicable to that rental.
